Welcome to the United Teachers Los Angeles (UTLA) Website.  By using, accessing, and/or visiting the UTLA website, social media platforms, or other UTLA online activity (collectively the “Website”),you signify your agreement to these terms and conditions (“User Agreement”).   Please read the complete Terms & Conditions before using this Website.  Thank you. 

If you do not agree to be bound by all of these terms and conditions, you are not authorized to use the Website.  UTLA may modify the terms and conditions at any time. Your use of the Website after a change has been posted will be subject to the modified terms and conditions.

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth herein, and to abide by and comply with this User Agreement. In any case, you affirm that you are over the age of 13, as the Website is not intended for children under 13 nor is any content aimed at children under 13.

UTLA presents the information on this Website as a service to members of the general public.  To the extent the information and publications on the Website are about legal issues related to the agreements that UTLA collectively bargains with employers, they are not intended to provide, nor are they the equivalent of, legal or professional advice.  You should not act or rely on any information that you obtain from the Website without first seeking the advice of our professional staff regarding the facts of your specific situation.  People seeking specific legal advice or assistance should contact an attorney, either by contacting a bar association Lawyer Referral Service, such as the services operated by the Los Angeles County Bar Association, or another source. Trademark And Tradename 

The terms “UTLA,” “United Teachers Los Angeles,” our logo and other trademarks, trade names, service marks and indicia of source (Marks) are owned by UTLA. You may not use our Marks in connection with any product or service that does not belong to us, nor in any manner likely to cause confusion about whether UTLA is affiliated with or the source, sponsor, or endorser of the product or service or in any manner that disparages UTLA.

Conditions Of Use

As a condition of your use of the Website, you warrant to UTLA that you will not use the Website for any purpose that is unlawful or prohibited by these terms and conditions. You may not use the Website in any manner which could damage, disable, overburden, or impair the Website or interfere with any other party’s use and enjoyment of the Website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Website.

You agree not to transmit or otherwise make available any unsolicited advertising, promotional information, bulk e-mail or other solicitation.

You agree not to use or launch any automated system, including without limitation, macros, “robots,” “spiders,” or “offline readers,” that accesses the Website in a manner that sends more request messages to the Website servers in a given period of time than a human can reasonably produce in the same period by using a conventional web browser. Notwithstanding the foregoing, UTLA grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. UTLA reserves the right to revoke these exceptions either generally or in specific cases.

You agree not to transmit or otherwise make available any content containing any “virus,” “worm,” “trojan horse,” or any other computer code, file, or program designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.

You agree not to alter or modify any part of the Website.

You agree not to circumvent, disable or otherwise interfere with security-related features of the Website or our sites or servers (or networks connected to our Website).

You agree not to harass, threaten, embarrass, defame, or cause distress to a person or entity on or through the Website.

You agree not to transmit or otherwise make available on or through the Website any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, discriminatory, or racially, ethnically, or otherwise objectionable, as solely determined by UTLA.

UTLA reserves the right in our sole and final judgment to determine whether conduct violates conduct requirements for the Website.  UTLA reserves the right, without limitation or prejudice, to suspend or terminate a user’s access to the Website, without prior notice and at UTLA’s sole discretion.

Through the Website, UTLA provides users with access to a variety of resources, including personalized content. UTLA reserves the right to modify, suspend, or discontinue the Website, or any part of the Website, at any time, for any reason without prior notice to you.  You agree that UTLA shall not be liable for any such modification, suspension, or discontinuance.

UTLA is committed to protecting your privacy both online and offline. This privacy policy explains the information UTLA may collect through your use of the Website, via phone calls, or any information sent to us by mail, and how UTLA uses, shares, and stores that information.

Collection and Use of Personal Information

UTLA collects your Personal Information only when you provide it to us voluntarily through various activities on the Website, via phone calls, or by mail. “Personal Information” includes your name, employee number, social security number, mailing address, home and cell phone numbers, school name, school type, employment type, credit card information and e-mail address.  If at any time you prefer to provide such information by phone, fax, or in writing, please visit the Contact Us section of the Website.

The Website also contains pages where you can join our e-mail newsletter, and may contain pages where you can register for a seminar or clinic, fill out an application for group legal services, apply for an job, or send an email inquiry.  

By submitting your Personal Information through the Website, you give your consent to UTLA’s collection, use, and disclosure of such information as described in this Privacy Policy. UTLA will use your Personal Information to fulfill your request or other purpose for which you provided it. UTLA may also use it for such purposes as sending you, either electronically or through the U.S. mail, information about our programs, services, and upcoming events as well as other materials that UTLA thinks may be of interest to you.  At any time, you may request that UTLA discontinues sending you these communications by contacting us with your request as described in the Contact Us section.

UTLA does not sell, trade, transfer, lease, or rent any Personal Information to any third party except as authorized by you or as disclosed in this Privacy Policy. To provide services to you, UTLA may share your Personal Information with third parties, such as those who facilitate activities on the Website or our programs. For example, UTLA may share your Personal Information with service providers that coordinate our mailings and email newsletters.  UTLA may also share your information with member volunteers who provide services to UTLA. UTLA will not sell or rent your Personal Information to third parties for marketing purposes and will require our service providers not to use your Personal Information for marketing purposes without your consent.

UTLA reserves the right to disclose your Personal Information to respond to a subpoena, court, search warrant, or other legal process, to defend UTLA against legal claims, or for other reasons that UTLA determines in good faith are necessary or appropriate. UTLA may transfer Personal Information to its successors or assigns, if permitted by and done in accordance with applicable law.

To provide us with updates in your Personal Information, to modify your preferences regarding supplying your information to third parties, to be removed from mailing lists, or to have your Personal Information removed from our database, contact us with your information or request as described in the Contact Us section of the Website.

At any time, you can contact us if you need to correct your information or want to be removed from any of our lists.  

Cookies and other Aggregate Information

The Website may contain links to other sites.  There is a possibility that those sites may use cookies to collect a visitor’s personal information.  UTLA cannot control the use of cookies by sites linked to the Website and is not responsible for their privacy practices or content.

UTLA uses reasonable precautions to host and maintain the Website in a secure manner and to safeguard it from unauthorized access. No transmission through the Internet, however, can be guaranteed to be completely secure, so you submit information at your own risk. If you send us an e-mail, it is not necessarily secure against interception.

Effective Date of Policy

The effective Date of this Privacy Policy is July 11, 2022.  This User Agreement may be updated as industry practices change and develop.  UTLA invites you to check back here or contact us at any time to obtain updates.

This User Agreement shall be governed by the internal substantive laws of California, without respect to its conflict of laws principles. Any claim or dispute between you and UTLA that arises in whole or in part from the Website shall be decided exclusively by a court of competent jurisdiction located in California. This User Agreement, together with any other legal notices published by UTLA on the Website, shall constitute the entire agreement between you and UTLA concerning the Website and supersedes prior agreements, if any, between you and UTLA relating to any matter dealt with in the User Agreement. If any provision of this User Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this User Agreement, which shall remain in full force and effect. No waiver of any term of this User Agreement shall be deemed a further or continuing waiver of such term or any other term, and UTLA’s failure to assert any right or provision under this User Agreement shall not constitute a waiver of such right or provision. This User Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by UTLA without restriction. This User Agreement and the rights and obligations created hereunder shall be binding upon and inure solely to the benefits of the parties hereto and their respective successors and assigns, and nothing in this User Agreement, express or implied, is intended or should be construed to confer upon any other person any right, remedy or claim under or by virtue of this User Agreement. You and UTLA agree that any cause of action arising out of or related to the Website must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
